These Terms and Conditions ("Agreement") govern your rental and use of our equipment. By renting any of our machinery, you are agreeing to be bound by these terms. Please read through them carefully before proceeding with your rental. If you do not agree to any part of this Agreement, please refrain from using our services.1. Agreement to TermsBy completing the rental agreement or accepting the equipment, you confirm that you agree to abide by these Terms and Conditions. This Agreement becomes effective once the equipment is delivered and the rental terms are confirmed. If any of the terms are unclear or you have any concerns, feel free to contact us before completing your rental agreement.2. Rental Process and Agreement- Booking: To rent an excavator, loader, or other equipment, you must fill out a booking form and sign a rental agreement. You will specify the type of equipment, rental duration, and location for delivery.
- Reservation Confirmation: Upon receiving your reservation request, we will confirm the availability of the equipment and finalize the rental agreement.
- Delivery and Pickup: We provide delivery and pickup services for your rented equipment. The delivery date will be confirmed in advance, and the rental period will start from the moment the equipment is delivered to your specified location.
3. Rental Fees and Payments- Rental Charges: Rental charges are based on the type of equipment, duration of use, and any additional services (such as transportation, insurance, or operator services). The charges will be outlined in the rental agreement and must be paid upfront unless agreed otherwise.
- Late Returns: If the equipment is not returned on time, additional charges will apply. The rental fee for late returns will be calculated on a daily basis.
- Deposit: A refundable deposit may be required to secure your rental. This deposit will be returned once the equipment is inspected and no damages are found upon its return.
4. Use of Equipment- Proper Use: The rented equipment is to be used for its intended purpose. You agree to operate the equipment in a safe and lawful manner, adhering to all operational instructions and guidelines.
- Prohibited Activities: You may not use the equipment for any unlawful activities, or in any way that could damage or impair its functionality. Unauthorized modifications to the equipment are strictly prohibited.
- Operator Qualifications: Only qualified and authorized operators should be allowed to operate the equipment. You are responsible for ensuring that the person operating the machinery is properly trained.
5. Maintenance and Care- Routine Checks: You agree to check the equipment regularly for any signs of malfunction or wear. This includes ensuring that fluid levels are maintained and that the equipment is functioning properly.
- Responsibility for Damage: You are responsible for any damage that occurs to the equipment during the rental period. This includes damage caused by misuse, negligence, or accidents. Any repair costs resulting from such damage will be charged to you.
- Return Condition: When returning the equipment, it must be in the same condition as when it was delivered, excluding normal wear and tear. If the equipment is excessively dirty, damaged, or inoperable, additional cleaning or repair fees may apply.
6. Insurance and Liability- Insurance Coverage: We offer optional insurance for the equipment to cover accidental damages or theft. If you choose not to opt for insurance, you must provide proof of your own insurance coverage.
- Liability for Loss or Damage: You are liable for any loss, theft, or damage to the equipment during the rental period. This includes any loss or damage that occurs due to improper handling, accidents, or weather-related issues.
- Indemnification: You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the rented equipment.
7. Termination and Early Return- Termination by Us: We reserve the right to terminate this rental agreement at any time if we determine that the equipment is being used in violation of these Terms or if payment is not made as agreed. In such cases, you will be responsible for returning the equipment immediately.
- Early Return: If you wish to return the equipment earlier than the agreed rental period, you may do so. However, you will still be charged for the full duration of the rental period as outlined in the agreement.
- Equipment Pickup: We will arrange to pick up the equipment at the end of the rental period or in the case of early termination.
8. Safety and Legal Compliance- Safety Regulations: You agree to comply with all safety regulations and laws regarding the operation of heavy machinery in your jurisdiction. This includes following local guidelines for equipment operation, worker safety, and environmental protection.
- Permits and Licenses: You are responsible for ensuring that you have the necessary permits and licenses required to operate the equipment at the specified location. Failure to do so may result in penalties or additional charges.
9. Dispute Resolution- Resolution Process: If a dispute arises between you and us, we will attempt to resolve it through direct communication. In the event that the dispute cannot be resolved amicably, both parties agree to attempt mediation before pursuing any legal action.
- Jurisdiction: This Agreement will be governed by the laws of the jurisdiction in which the equipment is rented. Any legal disputes will be settled in the courts of the appropriate jurisdiction.
10. Modification of TermsWe reserve the right to modify or amend these Terms and Conditions at any time. Any changes will be posted on our website or communicated to you directly. It is your responsibility to review the Terms periodically to stay informed of any updates.11. AcknowledgmentBy renting equipment from us, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. You are also confirming that you are legally authorized to enter into this agreement and that you will adhere to all guidelines and obligations set forth herein
